Important Certification Status Notice

Bradshire Mountain LLC previously participated in the EU-U.S. Data Privacy Framework. We are in the process of renewing our certification. For personal information received while our certification was active, we continue to apply the applicable Data Privacy Framework Principles for as long as we retain such personal information.

The Data Privacy Framework program provides a mechanism for personal data transfers to the United States from the European Union.

Scope of DPF Coverage

This DPF section applies to personal information that Bradshire Mountain receives in the United States from the European Economic Area in reliance on the EU-U.S. Data Privacy Framework.

This may include personal information processed in connection with:

  • website inquiries;
  • client communications;
  • business development;
  • consulting and technical services;
  • marketing technology and analytics implementation;
  • website, application, and software development;
  • hosting, operations, and support;
  • vendor, partner, and client relationship management.

This DPF section does not apply to human resources data.

DPF Notice Principle

DPF Choice Principle

You may opt out of:

For sensitive personal information, we will obtain affirmative express consent where required by the Data Privacy Framework Principles before disclosing it to a third-party controller or using it for a purpose other than the purpose for which it was originally collected or subsequently authorized.

Sensitive personal information may include information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health information, biometric or genetic data, or information concerning sex life or sexual orientation, as defined by applicable law.

DPF Accountability for Onward Transfer Principle

We may transfer personal information to third-party service providers, vendors, contractors, or other parties that perform services on our behalf.

When we transfer personal information to a third party acting as our agent, we require that the third party:

  • process the personal information only for limited and specified purposes;
  • provide at least the same level of privacy protection as required by the Data Privacy Framework Principles;
  • notify us if it can no longer meet those obligations;
  • take reasonable and appropriate steps to protect the personal information;
  • stop and remediate unauthorized processing if necessary.

Bradshire Mountain may remain liable under the Data Privacy Framework Principles if a third-party agent processes personal information in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.

When we transfer personal information to a third-party controller, we will comply with the Notice and Choice Principles and enter into appropriate contractual arrangements where required.

DPF Security Principle

We use reasonable and appropriate technical, administrative, and physical safeguards to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction.

These safeguards may include:

  • authentication and authorization measures;

DPF Data Integrity and Purpose Limitation Principle

DPF Access Principle

You may have the right to access personal information we hold about you. You may also request that we correct, amend, or delete personal information that is inaccurate or processed in violation of the Data Privacy Framework Principles.

We may limit or deny access where the burden or expense of providing access would be disproportionate to the privacy risks, where the rights of other persons would be violated, or where otherwise permitted by the Data Privacy Framework Principles or applicable law.

DPF Recourse, Enforcement, and Liability

We commit to resolving complaints about our collection or use of personal information in accordance with the Data Privacy Framework Principles.

We will investigate and respond to DPF-related complaints within 45 days.

In compliance with the EU-U.S. Data Privacy Framework (DPF), Bradshire Mountain LLC commits to resolve complaints regarding our handling of personal data in line with the DPF Principles. Should we be unable to resolve a complaint to your satisfaction or fail to acknowledge your complaint in a timely manner, we commit to refer unresolved privacy complaints to the European Data Protection Board (EDPB). For more information or to file a complaint with the EDPB, please visit www.edpb.europa.eu.

Additionally, under certain conditions, as a final option after all other dispute resolution mechanisms have been exhausted, you may invoke binding arbitration. For more details regarding the arbitration process under the DPF, please refer to the official DPF Annex I. These dispute resolution services are provided at no cost to you. Bradshire Mountain is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.

Required Disclosures

We may disclose personal information in response to lawful requests by public authorities, including to meet national security, law enforcement, regulatory, court, or other legal requirements.

We may also disclose personal information when we believe disclosure is necessary or appropriate to:

  • comply with applicable law;
  • respond to legal process;
  • protect our rights, privacy, safety, or property;
  • protect the rights, privacy, safety, or property of our clients, users, business partners, or others;

Client Data and Processor Activities

In some cases, Bradshire Mountain processes personal information on behalf of clients. In those cases, the client may be the controller or business responsible for the personal information, and Bradshire Mountain acts as a processor or service provider.

Where we process personal information on behalf of a client, we process that information according to the client’s instructions, our agreement with the client, and applicable law. Privacy requests regarding client-controlled data should generally be directed to the relevant client, but you may contact us and we will assist as appropriate.
